1. Mandatory Acceptance & Digital Signature

By accessing RyGuyLabs, you signify your irrevocable agreement to these Terms. You acknowledge that clicking "I ACCEPT & ENTER" constitutes a binding digital signature under the U.S. Electronic Signatures in Global and National Commerce (ESIGN) Act. We log your IP address, timestamp, and browser metadata as evidence of this agreement.

Unauthorized access that bypasses this interface is a violation of the Computer Fraud and Abuse Act (CFAA) and may result in civil or criminal liability.

2. Trade Secrets & "Black Box" Logic

All methodologies, including but not limited to the "Sales Gauntlet," proprietary scoring algorithms, 3D architectural assets, and custom JavaScript frameworks, are classified as Trade Secrets under the Uniform Trade Secrets Act (UTSA) and the Defend Trade Secrets Act (DTSA).

Strict Prohibitions:

• No De-Obfuscation: You are strictly prohibited from using browser Developer Tools or any other means to de-obfuscate or intercept script logic.
• No AI Training: You may not feed RyGuyLabs content, code, or frameworks into any Large Language Model (LLM) or AI system for the purpose of synthesis, replication, or commercial exploitation.
• Derivative Works: You may not create "copycat" versions of proprietary methodologies for personal or commercial use.
• Credential Sharing: Sharing login credentials or allowing others to access RyGuyLabs using your account is strictly forbidden.

All intellectual property, including trade secrets, software, frameworks, and methodologies, is protected under U.S. and international copyright, patent, and trade secret laws. Unauthorized use, duplication, or distribution may result in civil and criminal liability.

3. Anti-Scraping & Monitoring

This site employs active forensic monitoring. Any attempt to use automated tools (bots, scrapers, headless browsers) to map logic flows, extract code, or copy content will result in:

• Immediate and permanent IP ban,
• Referral to legal counsel for damages related to server strain, data theft, and intellectual property violations,
• Potential civil or criminal action.

Violations may also trigger enforcement under the CFAA and other applicable statutes.

4. Educational Disclaimer ("As-Is")

RyGuyLabs provides high-level educational frameworks. All content is provided "AS IS" and "AS AVAILABLE".

• We do not guarantee any financial, legal, social, or professional outcomes from using our frameworks.
• You assume all liability for the application of our techniques.
• Our content is strictly for educational purposes and does not constitute professional advice (financial, legal, medical, or otherwise).
• RyGuyLabs is not responsible for technical interruptions, server downtime, or browser compatibility issues.

All warranties, express or implied—including fitness for a particular purpose and non-infringement—are disclaimed to the fullest extent permitted by law.

5. Limitation of Liability & Indemnity

To the maximum extent permitted by Florida law, RyGuyLabs’ total liability for any claim arising from your use of the website shall not exceed the amount you paid to access the service, if any.

You agree to indemnify and hold harmless RyGuyLabs against any third-party claims arising from:

• Unauthorized sharing of proprietary materials,
• Breach of intellectual property protections,
• Any other violations of these Terms.

This limitation applies to all claims, including negligence, tort, breach of contract, statutory claims, and any other legal theory.

6. Aggressive IP Enforcement & DMCA

RyGuyLabs employs Digital Fingerprinting on all assets. If we detect unauthorized use of our 3D models, "Sales Gauntlet" logic, or any proprietary content on a third-party platform, we will pursue:

• Immediate DMCA takedowns,
• Metadata reporting to hosting providers,
• Civil litigation for statutory damages under the Copyright Act.

DMCA Procedure for Copyright Owners:
Notice must include:

• Signature of the copyright owner or authorized agent,
• Description of the copyrighted work,
• URL(s) of infringing material,
• Contact information,
• Statement of good faith belief that the use is unauthorized.

Repeat Infringer Policy: Accounts, IPs, or entities repeatedly infringing on our IP will face permanent termination and litigation.

7. Dispute Resolution: Binding Arbitration

Any dispute arising from these Terms shall be resolved exclusively via binding arbitration in Pasco County, Florida, or the nearest AAA location, governed by the laws of the State of Florida.

You expressly waive any right to a jury trial or participation in class-action lawsuits.

Venue for enforcement or court proceedings related to arbitration shall also be Pasco County, Florida, if arbitration enforcement is necessary.

8. Severability, Non-Waiver & Updates

If any portion of these Terms is deemed unenforceable, the remainder remains in full effect.

Our failure to enforce any provision shall not be considered a waiver of our rights.

RyGuyLabs may update these Terms at any time to reflect new security measures, legal requirements, or policy changes. Continued use constitutes acceptance of the revised Terms.
